Never been so stupid in my life. I bought a used car from a dealer with 3 month warranty, MOT and service for £5k. When I was presented the invoice listing the garage as the seller, it also stated ‘sold on behalf of customer’, it was mentioned when I was negotiating a price. I questioned it and the dealer says no it’s only if something goes wrong the previous owner has to pay and you have a warranty, it will be like buying from us.

Behold.. the vehicle has had serious problems and now guess who is responsible, me as I have now been told by the garage it was a private sale.

I am not very experienced with the trade and took the warranty as the safety net. So.. don’t be as foolish as me. Many garages seem to be using this sale or return tactic but not giving the customer rights. I’ve been played a good one.
 
Trading Standard's would be who i was contacting . You may find they are are aware of the dealer already.

You get 6 months warranty on a used car thought there is ways they can get out of it .

What are my consumer rights after 30 days?

If a problem is found after 30 days, but within six months of purchase, you can request a repair or a replacement vehicle. The onus is on the seller of the car to prove the fault wasn’t present when the car was sold; if they can, and you’re likely to have known about it, you won’t get a refund.



When it comes to repairs, the dealer has one chance to fix the fault. If the fix doesn’t work, you are entitled to a refund. You won’t get the full purchase price back, though. Any usage of the car will be taken into account and the refund will be adjusted accordingly.

Under previous legislation, the supplying dealer was allowed more than one attempt to rectify the problem and it was considerably more difficult to get a refund on a car, so the Consumer Rights Act is good news for consumers.

If a fault appears after six months of ownership, it is down to you to prove that it was there at the time of purchase. To do that, you’re likely to have to get an expert to examine the car or component and get a written report about it.
 
As above I would be contacting trading standards.
From what you say it sounds like you have a contract with the garage, as it sounds like they invoiced you, not the mysterious seller?
NB: its a bit like when you buy a tv from Currys, which then develops a fault and they tell you its covered by manufacturers warranty, but the contract the buyer has is with them (currys) not the manufacturer, no matter what they claim.
 
Thanks for the replies, yes I have been in touch with trading standards and followed the procedures but they are sticking with the private sale story and the seller apparently won’t pay for any repairs even though I have never met the person. I won’t give up on this but I think people should be wary of these tactics, I’m sure this is not how most garages do business but some don’t seem to mind. I feel very foolish and very naive.
 
Icbw but if he's a trader, it's him that's selling it, end of.
I just had to go through similar with a car I bought after mine was written off.
I did however buy it from a main dealer. Car developed expensive faults after 32 days of me owning it.
I ended up with a full refund after quoting the consumer rights act. Luckily they were switched on enough at head office and refunded me.
The car had been at their garage for 3 weeks!
 
There's quite a large dealer in halifax who are well known to trading standards but continue to trade. Forecourt full of Range rovers etc and they don't actually own any of them. God help you if you develop a problem after purchase.
 
How old is the car, and how many miles?

For £5k I wouldn't be expecting it to be perfect, and anything wear and tear related would also be out of warranty scope.

What has actually failed?
