New York State Airgun Law Proposal Update - Hard Air Magazine

What can we do about this New York State Airgun law proposal? If you live in New York State, please take action to defend your rights!

Two separate Bills, S9215 and A10701, propose to designate all air guns – from your Crosman 760 and Daisy Red Ryder to expensive PCP models designed for hunting – into the “Imitation Weapons” category.

This will require a barrel plug that renders them nonfunctional and changing the coloring to bright colors that “do not resemble a firearm”.

Note that New York State doesn’t seem to want to recognize the inconvenient fact that there’s plenty of brightly-colored firearms being sold. As is well known, brightly-colored firearms are all the rage today. (Oops, sorry, I’m using logic again – must stop that!).

Effectively, this would ban the future sales of airguns within the State of New York.

Some areas are very strict on them already .

New York​

In New York:

  • In New York State, you must be at least 18 years old to purchase an Airsoft gun. Retailers and federal guidelines enforce this age limit for sales, treating Airsoft guns similarly to BB guns or air guns due to their classification under non-powder firearms.

  • Airsoft, BB, and air guns all require special licenses to possess in New York City. Under NYC Administrative Code Section 10-131(b), it is unlawful to sell, offer to sell, or possess any air pistol, air rifle, or similar instrument in which the propelling force is spring or air without proper licensing.

  • Owning an Airsoft gun in NYC without the required license is illegal and can result in arrest and criminal charges.

  • Additionally, owning an Airsoft gun without bright neon coloring or transparent construction can result in charges of possessing an imitation weapon—a misdemeanor offense.

  • Use of air pistols and rifles is permitted in NYC only for licensed amusements or at authorized shooting ranges.

  • Outside of NYC, New York State Penal Code Section 265.05 prohibits anyone under 16 years old from possessing any air gun, spring-gun, or similar instrument.

  • Adults outside NYC may possess Airsoft guns without a license, but cities are permitted to impose additional restrictions within their boundaries.

  • NYC Administrative Code Section 10-131(b)
Air pistols and air rifles; selling or possessing.

1. It shall be unlawful for any person to sell, offer to sell or have in such person's possession any air pistol or air rifle or similar instrument in which the propelling force is a spring or air, except that the sale of such instruments if accompanied by delivery to a point without the city, and possession for such purpose, shall not be unlawful if such person shall have secured an annual license from the police commissioner of the city authorizing such sale and possession. The sale and delivery of such instruments within the city from one licensee to another licensee, and the use of such instruments in connection with an amusement licensed by the department of consumer and worker protection or at rifle or pistol ranges duly authorized by law shall not be considered a violation of this subdivision.

2. All persons dealing in such instruments referred to in this subdivision, shall keep a record showing the name and address of each person purchasing such instrument or instruments, together with place of delivery and said record shall be open to inspection during regular business hours by the officers of the police department of the city.

3. Every person to whom a license shall be granted to sell, possess and deliver the instruments described in this subdivision shall pay therefor an annual fee of ten dollars.

As far as I'm aware the USA has no power limit on airguns (seem to recall one being 1500ftlb!!!!

I got the impression (regarding upper power limit) it wasn't? Would seem daft as a LOT of states require no licence just a background check for firearms, and black powder guns are not even considered firearms…

Some states do class airguns as firearms .

States that Classify Airguns as Firearms
  • New Jersey: Defines all non-powder guns (air guns, BB guns) as firearms.
  • Rhode Island: Defines all non-powder guns as firearms.
  • Illinois: Defines certain high-power and/or large-caliber non-powder guns as firearms (specifically, any air gun over .18 caliber shooting over 700 FPS is treated as a firearm and requires a Firearm Owners Identification (FOID) card).
Plus some require licensing like NYC as my link above show's


Also airguns are not covered b the 2nd amendment as some court cases have ruled. People v Nivar is one case.

Anybody who wishes to purchase an airgun product from AirForce Airguns is expected to know their state and local laws and comply fully with them. For your information the following are examples of state laws governing air gun products:


ILLINOIS


Effective July 13,2012: There is no velocity limit on airguns below .18 caliber, and airguns are no longer considered firearms by the state. Airguns over .18 caliber must still have a velocity of less than 700fps
Residents of AURORA, IL: Air Rifles are prohibited
Residents of CHICAGO, IL cannot buy airguns directly from us.


NEW JERSEY


Residents of NEW JERSEY can buy airguns through a designated local gun store after acquiring the appropriate firearm permit (Airguns are considered firearms per NJ state law: Title 2C:39-1). Cite from New Jersey law: “A ‘firearm’ means any handgun, rifle, shotgun, air gun, gas gun, machine gun, or ‘any gun’.” Your local gun store must fax a copy of their FFL to us before we will ship the gun you ordered.


NEW YORK RESIDENTS:


Based on the state law we do NOT and can NOT ship airguns to New York City and its boroughs (Manhattan, Brooklyn, Bronx, Queens, Staten Island, these zip codes are: 100xx-104xx, 111xx, 112xx-114xx, 116xx)


PENNSYLVANIA


Residents of Philadelphia, PA: Airguns are Prohibited


WASHINGTON D.C.


Residents of Washington D.C.: Air Rifles are prohibited

I'm not really bothered about what's going on over there, I'm more worried about what's going on here ;):)
 
This guy has a good take on it. Basic intent is to remove the next generation from pistols n rifles of any type.
 
It could be an attempt to limit deaths or injuries from mistakes. For example, a bright orange pistol shaped object is more likely to be Airsoft or Airgun than the real McCoy. However, think a bit further, someone who wants a few extra seconds will paint a real weapon the same colour.
Is that too simplistic?
And someone with a weapon pointed at them is liable to shoot first and ask questions later

That already happens . Many real firearm's have been seized that look like toys.

They have even seized AR style rifles with orange tips painted on them .


Some in the US have their real firearms painted in a range of colours and some manufacturers even marketed colourful ones .



I believe some have even been found in the UK also.

AEA Zeus .72, iirc AEA are or have brought out a .95 which is 4000 ft lb so well into nitro express territory.
